“He’s not a citizen, so isn’t entitled to due process” – My brother in law
5th Amendment doesn’t say “No citizen” it says “No person” is entitled to due process.
I’m going to assume yours is a typo, but here’s the text-
“nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law;”.
No person is entitled to due process. Got it. /s
“You’re not a citizen, so you aren’t entitled to due process”
“Yes I am”
“Huh, how are you going to correct me without due process? Have fun in forever prison! Goodbye!”
Ask them to prove they’re a citizen. Driver’s licenses don’t count. Being white doesn’t count (could be Russian).
No, don’t ask them. They get no chance to challenge your assertion at all. That’s the point. That’s what no due process gives you. That is what they are claiming is right and just and the law. The government says “trust us bro, this guy is an illegal alien terrorist and deserves this” and then they disappear you forever, no questions allowed to be asked. You go from arrested for absolutely anything at all to the gulag with nothing in between those two steps.
This idiot thinks that that couldn’t apply to himself, to other citizens, to his parents, his spouse, his kids… he is wrong. If they do not give you even a second in court, there is absolutely nothing you or anyone else can do to stop it. It can happen to citizens. It will. Hell, it probably already has. The only thing that may be stopping it at the moment is the willingness by the administration to do so. The one that has openly, publically and repeatedly expressed that they absolutely want to and are willing to deport citizens to foreign forever prisons, as well. He thinks these are the guys that can be trusted to not target citizens. He is a fool.
